Legal Question in Discrimination Law in Oregon

where could I go if i feel that i am being discriminate against for my race

I work in a head start program for migrant children and I work in the kitchen. The majority of the people are spanish. There are a few of us that are not and it seems that they are alway giving us a hard time or trying to get us fired. I really want to know where I could go to get some help on this situation.

The first thing you should do is communicate your concerns to your employer and state that your Hispanic co-workers are harassing you because of your race and/or national origin. Emphasize the facts about who said what, when, and where.

If your emplpoyer already has knowledge of the situation and has failed to correct it, or if a supervisor or higher level management person is involved in the harassing conduct, you can file a complaint with BOLI (Oregon Bureau of Labor and Industries) and/or the EEOC for racial or national origin harassment. You must file a complaint with BOLI within a year of the occurrence of the culpable conduct. You must file a complaint with the EEOC within 300 days of the occurrence of the culpable conduct. You must file an EEOC claim before pursuing your federal rights in court (if any, e.g. employer must have 15 or more employees). There is no requirement to exhaust your administrative remedies before pursuing your state law rights.
