Joint check

My wife and i file taxes jointly. I have received a check from the irs with her name and my name on it. My wife has left the state for parts unknown. My question is can i leagally sign her name on the check and cash it. We have no bank account period.

Yes. Given that you are your wife's husband, you presumptivelu have her authority to sign her name on the check and deposit it into a JOINT ACCOUNT.

If you have "no bank account period" you are probably going to run into a lot of practical problems in trying to case the check. Best to communicate with your wife and make arrangments for the both of you to endorse the check and cash it togeher, splitting the proceeds as may be mutually agreed.
