Legal Question in Civil Litigation in Oregon

I went to a car wash and when I came out, my windshield was cracked from top to bottom. The attendant told me he noticed a small crack at the top of my windshield when I went in. I was not aware of a crack. he said they have cameras and the owner will call me back. Who is liable? If he had told me I had a crack I wouldn't have gone through the car wash! And there are no signs posted saying they're not liable for damage.

Did they give you a receipt? It probably disclaims liability and says all disputes shall be decided by arbitration, which is of course rigged against you. In any event, you can file a claim against the car wash in small claims court, and you may well win.
