Legal Question in Real Estate Law in Oregon

I am a renter in Oregon. The seals on all the windows in my apartment are blown, and are causing our heating bill to be high and there to be major mold problems. I am having problems getting my management company to complete repairs because the owner has not responded to them. About 6 months ago, I tried to work with the first management company to deal with this issue, and they didn't do anything. Our current management company brought a person in to look at the windows, confirmed they all needed to be replaced, and a quote for that work. That was a month and a half ago. The owner has not responded to their request. I'm now having problems with mold on all the windows and I found mold on the bottom of my canvas laundry bag. There is constant condensation on the windows despite the heat being on and the blinds being open. This is turning into a health issue and I don't know what to do to get the management company to actually replace the windows.

ORS 90.320 provides the requirements that a landlord must follow. http://www.oregonlaws.org/ors/90.320 It sounds like your landlord is in breach. ORS 90.360, 90.365, and 90.368 provide tenant's remedies, and each requires you to inform your landlord in writing of your intention to do so. You should keep copies of all notices. If after giving written notice and allowing your landlord the required amount of time to fix the problem, something still has not been done, you should contact your own attorney to review the specifics of the notices and the violations before withholding rent, abandoning the tenancy, or repairing the problem yourself.
