Legal Question in Workers Comp in Oregon

terminated 2 days after injury

I was terminated from employment 2 days after filing my injury report with the employer. It now looks like I will be having surgery and possibly permant damage from the injury. My claim was accepted by the insurance carrier. Can I draw workers compensation payments as I am no longer elgible to draw unemployment insurance because I am not pyhsically able to perform my duties?

If you can't do your past work but could do other work limited by medical restrictions you are still eligible foe unemployment benefits. As to WC benefits you are potentially eligible for TTD if the doctor has authorized the time loss and you can show that the termination was due to your inability to do the job
