unmarried man and woman...have a joint bank account...one person takes out money and buys a cd in there name only. without permission

A jointly held bank accounts mean that both parties own 100% of the account. That means, unless you have made other arrangements with the bank, either party can withdraw some or all of the money and use it without the permission of the person on the joint account.
