Legal Question in Business Law in Pennsylvania

Owning/Selling a Patent document

I have the legal Patent document of a product that no longer exists. The business folded in 1985. I want to sell the document as a collector item but do not know if I can legally do so. The document was fished out of a garbage dumpster years ago by an employee of the company when the founder discarded the document and then it was obtained at a flea market about 8 years ago. Can I sell the document without any legal ramifications?

Re: Owning/Selling a Patent document

You asked about selling a document.

Generally, the lawful owner of property can dispose of it in any way they wish. You might be proscribed from selling a copy a document, but I cannot see any reason that an owner of an original document would be prevented from selling that original. And, just to make this clear, since you bought the document from a person who obtained the document lawfully, or at least you were reasonably unaware of any unlawful action, then you are the lawful owner.

Roger
