In deciding issues of child support, the Court treats the parents as if they were still together. So, if the parents of the child were together, the child would benefit by any award given to one of the parents. So, if the custodial parent files a petition with the Family Court and informs the Court that the non-custodial parent has received a settlement award, the Judge has the power to Order the parent who received the award to pay x% of the award to the child. If this should happen, it would be best to ask the Court to Order that this sum be set aside for the child's education and not used by the custodial parent for day to day expenses.
