when testifing in small claim court is it not proper to ''swear parties in''?

If there is testimony in front of a judge it should be sworn. As for a hearing in front of an arbitrator or mediator, it is not required but it is the norm. These cases are mostly informal, but they are not so informal that all of the rules go out of the window.

Small claims can be expensive, if you feel your situation warrants it, maybe you should appeal and use an attorney on that.
