Legal Question in Consumer Law in Pennsylvania

Fabric question

If I purchase fabric at a fabric store that has a team logo on it and has on the side of the fabric ''TM / c 2005 NFL Properties'', can I make something with the fabric to sell at a craft show or other event, or is it against some law? The fabric was rather expensive. I would really appreciate your answer. Thank you!

Re: Fabric question

You asked about potential licensing problem.

Fear not. There is no problem with what you propose to do. The idea behind licensing is that people don't trade off of the good name of a marque that cost the owner time, effort and money to develop. In this case you have already payed the licensing fee for the marque and the use is limited. If you were to mass produce these things there may be an issue, but even then it would be questionable.

In this instance what you will be selling is the effort involved in making the product and incorporating a marque that someone else licensed. Licensors can be irritable people, but where someone is not actually involved in trying to rip off their marque there is little reason for them to expend much if any effort in stopping the actor.

Hope that helps.
