Timeframe for receiving an automobile title

Purchased a vehicle on ebay 26 April 05. Flew to Pennsylvania (we live in North Carolina)on 27 April 05 to pay for and pick up vehicle. We were given a temp tag and told we would receive the perm tag within 30 days. After 30 days we had not received the tag so we called back the dealership. We were told that it sometimes takes 6 weeks and that they could not issue another temp tag. After 6 weeks we called back - they said they would look into it. No response. We contacted them again and were told that the deceased owner's daughter did not have permisiion to sign over title and were working on it. Another couple of weeks and we called the dealership again - it seems the daughter was on vacation and was just now working on the title issue. It is now 19 August 05 and we still do not have a title and are unable to drive the vehicle. They will not refund our money and have made no attempt to compensate us for the hardship the lack of vehicle has incurred. What are our options?

If the vehicle was offered with a "Clean" title the sller has breeched the contract by failing to deliver the title. The seller can be held responsible for consequential damages or you can choose to have the contract voided as they have not performed ( You get yyour money back, you give up the vehicle) Often a demand letter from an attorney can resolve an issue prior to filing suit.
