getting 4500$ downpayment returned after loan is denied

what can i do legally to get my money back from a dealership when the loan did not go through and they had already had allowed my son to put plates and insurance on a car before the loan was approved? we put 4500 down on a 9999$ car. they are giving a the run around

If you do not have the vehicle, but gave a deposit, you are entitled to a refund of the $4,500. That is a basic contract principle. You have many laws and legal theories that will allow you to prevail. You have two choices. The first is to contact the BBB. The BBB will get in touch with the dealership within a few days to try to resolve your complaint. If the dealer is reputable, they will work something out. Keep in mind that the BBB does not have any legal power to compel the dealer to comply. The second choice, and probably much more effective, is to hire an attorney. You have a pretty good lawsuit there, for breach of contract and possibly under the Pennsylvania Unfair Trade Practices Act and Consumer Protection Law. Your chances of being successful in a lawsuit are pretty good. Happy Holidays.
