Legal Question in Credit and Debt Law in Pennsylvania

Credit Card_collection agency

I have had a collection agency basically chasing me for over two years or more. CommonWealthFinancial Systems claims that I have an outstanding debt with a former card company and have attached ridiculous fees. All debts were paid off (direct to credit card companies), a few months later I started recieving letters, threatening with legal action, wage garnishing, etc. I live out of the country, so I do not get the harassing phone calls, but my parents do. They have informed them not to call them, they have nothing to do with it, they have been called liars and have even left threatenting and harassing messages on the answering machine. At one visit I was home, I took a call from them and someone misrepresented themself as an attorney and gave more threats of litigation.

I do not have all the essential paperwork and the collection agency says there is none, due to they bought the debt and the card company no longer has it. however, I have never received anything that validates the debt and/or ever a certified letter or summons.

They recently called and upset my mother, accusing her of being my wife and lying, hiding from them and what a dead beat I was. This is the final straw, I owe nothing to these people.

Re: Credit Card_collection agency

from the fact you have stated it appears the creditor may have violated the fair debt collection act as well as Pennsylvania corresponding act. You may therefore have actionable claims against the creditor. i suggest you immediately contact an attorney. I would also suggest you check your credit report to see that no adverse information has been placed against you.
