Legal Question in Credit and Debt Law in Pennsylvania

MY HUSBAND OF 6 MONTHS HAS ASKED ME TO MOVE OUT AND DOES NOT WANT TO BE WITH ME ANYMORE. What am I entitled to? I live in NY state and what do I need to do first?

Why then are you asking a Pennsylvania attorney and why is this a debt collection question? You can try re-directing your question to a NY-licensed family law attorney. NY is an equitable distribution state. What you are entitled to will be done in accordance with NY law if you live there. Do you own property in NY?? In that case, you can file for divorce in NY but may have to bring any equitable distribution action in the state where the property is located. Most states require that in order to file for divorce, one of the spouses to the marriage must have lived in the state where the action is filed for at least 6 months. Differing states have different separation requirements. In PA its either 90 days (with consent) or 2 years. It also depends on whether you file under fault or no-fault grounds. I suggest that you see a family lawyer in the state in which you either own marital property or where you intend to file for divorce. You may also be entitled to spousal support/alimony depending on circumstances. And if you are pregnant or have a child fathered by your husband, there will also be child support and custody/visitation issues.
