Procedure to Collect on Unpaid Loan

In March of 1998 I loaned my then boyfriend $5,000.00 to pay his back boat payments. There was no paperwork involved; however, I have copies of the canceled check and had written on the front of the check when given to him, "Loan, regarding boat". He promised to repay the money within 3 months and to date has not done so. The boat is now for sale and I am afraid he has no intention of repaying this money. What is the procedure to collect this loan?

Make a request, and then if he refuses, find the district justice in your area, and file a suit.

You have to file a lawsuit. You have no other alternative unless your boyfriend with give you a lien that can be placed on the title to the boat. Consult an attorney quickly or you will suffer a potential loss if your boyfriend does not honor his committment. At least get him to sign a memo acknowledging the debt. If your boyfriend will not do that he has no intention of making repayment of the loan.
