Legal Question in Credit and Debt Law in Pennsylvania

being sued for writing a bad check

My fiance has just been summons to appear in court due to a check that bounced in March. We thought that they would resumbitt it and everything would be fine. We didn't hear anything else about it til now. We didn't know that the check was going to bounce it was all a huge misunderstanding. We contacted the guy who ownes the business and he called the district justice today. Apparently even if he wants to he can't drop the case. We are now at a loss. We don't know what to say infront of the judge and what the penalties for this charge can be. If anyone can help me I would greatly appreciate it.

Re: being sued for writing a bad check

Much more factual data is needed to properly advise you. However, prior to bringing a criminal action in Pennsylvania for giving a check that bounced ten days notice must be given to allow the person who wrote the check to honor its payment. If such notice was given, I strongly suggest you seek legal counsel. If I can be of assistence let me know. Gerald Hershenson 215-579-9390
