Legal Question in Criminal Law in Pennsylvania

assult

i was accused of beating up my daughters father. i am charged with simple assult, conspiracy, hassament, stalking. my current boyfriend was the one who did it. He then broke-up with me because he did not want to get in trouble. i taped a converstaion that with him that states he is going to change his story in court and have all the charges put on me. he said that i am going to lose my daughter and go to jail. i never touched my daughters father execpt to try to break them apart when they were fighting. i am scared and do not know what to do. my hearing is tomarrow and i have a public defender, my daughters father has a lawyer, and my ex has nothing. i took pictures of myself to show that i did not have a mark on me and i have the tape, and the clothes that i was wearing tht night. my daughters father said that i was all scuffed up and i had blue leather pants on and they do not have a mark on them. he also filed a pfa agaist me, but at my arraingment he was next door looking at cars. why was he doing that if he is so afraid of a 110 pound girl? what do you think the out come of the case will be?

Re: assult

There are a lot of moving parts in this case, but let's start with this. How did you make the tape? If you taped a phone call, it's not admissable in court, and you could get in more trouble for making the tape if he didn't know he was being taped.

You don't say why your daughter's father is saying that you did it if it isn't true. The best thing to do is to postpone your hearing and get a lawyer who has enough time to deal with all of the various issues here.
