Legal Question in DUI Law in Pennsylvania

arrested but no citation

A year and a half ago I was arrested for a DUI in PA. I was taken to a small local station and had my photo taken and that was about it. The officer did not give me a written citation and did not fingerprint me. All he said is that I would receive notice in the mail of my court day. It is now over a year since the incident and I have received nothing. Do you think that I was still charged?

Re: arrested but no citation

This is a little tricky. If the paperwork got "misplaced" you don't want to be the one to have someone go looking for it! On the other hand, if there is a warrant out for you because of failure to appear (even if you never got notice because it was sent to wrong address) You could be in for a rude surprise if you get stopped in PA for a traffic offense or when you try to renew your Ohio license. It should be relatively easy for an attorney to find out if there are any pending charges, bond forfeitures, etc. If you want to discuss this further feel free to contact me. No charge or obligation for initial call.

good luck
