Legal Question in DUI Law in Pennsylvania

Eligible for ARD? 20 years old, crashed into ditch, DUI in PA

Hi, I'm 20 years old - I drove my car into a ditch (backend first) trying to avoid hitting an animal. They towed my car and called the police. The police gave me a breathalyzer and I blew a .04. Although this is half the legal limit normally, because I'm underage I received a DUI. My car is still in the impound (thanks to the holiday weekend). I've heard about this ARD program - but I'm wondering if I qualify. I'm a first time non-violent offender, but I am currently doing community service for a stet charge in the state of Maryland for ''unsafe backing of a vehicle'' - do you think that I will still qualify? In addition, I have an Rx for Adderall and had 1.5mg of xanax in my system at the time (not to mention probably traces of marijuana from weeks ago). Will this affect my sentencing or likelihood to be accepted into ARD? Thanks again.

Ask your attorney of public defender. If you don't have an attorney and want to hire a qualified private attorney, I would be happy to discuss the ARD program and other options that may apply in this case.
