Who is resposible for bodyily injury and replacement of car

Myself and my husband was hit from behind by a drunk driver, my insurance company is stating his insurance company is to replace our car and pay for medical bills. How ever this person had no insurance, and no driver license. How can we get compenstated , I am in very bad shape,hurt back and neck, can not stand, sit or lay down to long. Had a MRI and now waiting for test results. My husband hurt his back and leg. We really need advice on how to handle this matter.

Sorry to be so blunt, but you need to get to a PI attorney asap. He will be able to explain different insurance coverage issues as well as potential claims against the drunk driver. If you are in the eastern portion of the state feel free to call me.
