Legal Question in DUI Law in Pennsylvania

Underage D.U.I.

MY daughter (age 18) was in a severe car accident. She was driving and there were no passangers.She lost control and hit a tree.The paramedics did not suspect that she was D.U.I. because it was 7:30 am and she told them she was on her way to work. Upon taking her blood in the traumu unit it had a b.a.c. of .12. I am considering providing this info to the police.This is her first DUI offense, but her lic. was suspended before for reckless driving.She needs a wake-up call desperately. I would like her to be chargedwith a DUI,but don't want this to haunt her forever. Please advise. Thanks much.

A D.U.I. may haunt her forever. It is devastating to a person's record, it takes away their chances for A.R.D. later on if they either get another or commit some minor offense, it hurts with employment, and it generally has a much more negative than positive affect.

However, if your daughter is over a .10 at 7:30 in the morning, she needs help. It is just that turning her over to the tender mercies of the criminal judicial system, in my opinion, is not the best way to get her help.
