underage dui

my son got underage dui, possession of a small amount of marijuana, and bowl (.05) then 5 weeks later another underage dui (.04). He is 18 will he go to jail?

If he's 18, he's not underage. Did this happen when he was 17? It sounds like an interesting situation if so. You need to retain an attorney local to your County to minimize the consequences to your son in any event. My best guess is that he would not go to jail and that he would be eligible for ARD if the offenses occurred before he turned 18 but that is up to the discretion of the District Attorney in your County.
