Amount of money exempt from nursing home?

My father was in a nursing home for rehab. on two different occasions and didn't recover the second time. we applyed for state funding the first time and didn't receive approval till a week before he pasted away the second time he was there, so we did notknow how much they would pay for only what the nursing home said, so no money went to them from him. They sent him estamented bills and when I called they said no to worry about them that the state would take care of it. Now they have got an attorney and said I'am responsable for the patient co/ pay. My father only had about $2300.00 to his name and I used it to take care of funeral.The nursing home said I had no right to use this money that it belonged to them, now they are threating to sue me for the money, was I right in using the money for my fathers last wish, Do they have claim on this?

My deepest condolences opn the loss of your father.

The nursing home can sue for anything it wishes. The fact is you can't get bllod for a non-existent stone. In my opinion the money wasn't theirs until they sent a bill for services. As you used the money for services for your father you probably have no liability. The nursing home was owed money by your father and not you.

If on the other hand you had used the money for your own purposes the result may be different. But as you explain it, the money was used for properly. Unfortunately, this won't prevent the nursing home from suing. But a decent attorney and reasonable judge will make short work of setting matters to right.
