Legal Question in Family Law in Pennsylvania

I need an answer for my daughter

My daughter has been living with a man and together they have a child.

I want to know if the father can take the baby from my daughter since he will move back home and his mother will be there.

My daughter, since she is not married, has decided to move in with another man.

She currently is not working due to the fact she takes care of the baby.

Please send me your advice

Re: Who will get residential custody?

I cannot predict what a Court would do in this situation. The choice of who will be the residential custodian of the child is a very complicated one and could swing on facts of which you may not even be aware at this time. The Court would make the determination based on what it believes is in the best interest of the child. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that your daughter has not retained an attorney, before she takes any further action, she should contact an attorney (either me or someone else) to discuss her matter in more detail. Only then will she be able to rely on the advice. I will be happy to assist her. However, she needs to call me at 856-546-8010. If she mentions LawGuru, there will be no charge for her first consultation. Good luck! Rob Gleaner
