Legal Question in Family Law in Pennsylvania

child support (back pay)

My x husband and I divorced in 1998 we had separated 6 yrs prior to being divorced. My now 17 yr old daughter has live solely with me and my current husband since age 8. Up until about 3 yrs ago I was a stay at home Mom and my current Husband was the sole support of our family. There was no order for support at the time of divorce. Can I get back child support for all the years he hasn't paid support? He hasn't provided her with anything (school clothes, insurance.. etc) She has not resided in the same state as him since she was 8 years old.

Re: child support (back pay)

Generally in PA child support is only available from the date you file the petition.

It normally ends at age 18.

Good luck to you.

Re: child support (back pay)

You asked about seeking retroactive child support.

In rare cases support may be made for a short retroactive period. The potential is likely very small that any retroactive support would be granted unless there were extenuating circumstances.

You really need to sit down with a family law attorney and discuss possible options.

Roger
