Legal Question in Family Law in Pennsylvania

child support/custody

i am a 27 yr old man and i have an 8yr old daughter, he mother and i broke up when she was 3months old. in march of 2005 her mother was murdered along with her little sister and aunt,at the time my daughter was living with her mother, little sister, aunt, and grandfather in pa.at the time of the murders my daughter was with me, i attempted to file for custody asap in in the state where i live (de.) but the court told me i didnt need to because i would atomatically get custody, so i trusted them and just kept my daughter with me, a week later my daughters grandfather her mothers father sued for custody and won, i tried to fight but he had a lawer and i tried my hardest to get a lawer but i had no money my fiance was pregnant at the time and we were living with her mom. i tried to get legal aid but because the case was in pa. and i live in de. i didnt qualify. just recently the grandfather requested child support and at the confrence on jan 10 they want about 55% of my pay, i dont know what to do i didnt agree so there is a hearing on feb.23, i cant afford a lawer and i really cant afford the child support payments. i dont see how he can do this she is not his daughter she is mine and belongs with me.PLEASE HELP i am desperate!

Re: child support/custody

You need representation, first to contest the amount sought as support but more importantly custody.

Rather than going through legal aid you should seek assistance through a private legal clinic. A clinic may also be free and is a little more loose about the clients that they can accept. Widener University Law School has a legal clinic that may be able to help you. They are located on Concord Pike on the north side of Wilmington. Call the clinic to arrange an appointment. They represent folks in both PA and DE.

Your only other choice is private representation.

Regards, and good luck.
