divorce -mentally disabled couple

Mentally disabled couple marries but wife's mother lived in because they were unable to live unsupervised. Wife's mother also contributed $98,000.00 to down pymt on house with a verbal agreement that she would live with them until her death. Husband left without any explanation, and is now stating the money was a gift. Wife's attorney says that mother has no rights to her money. Would there be any exception due to the fact that the couple needed supervision? What about the verbal conrtact?

The problem with verbal contracts is not what people say to make them; but what people say later when they want to deny them. Mother's course of action was very unwise. If the couple was "mentally disabled" how could they make a contract? How disabled? Are they competent? Do they have guardians? Nothing in writing when $98,000.00 changes hands? If mother didn't have an attorney she should get one immediately.
