Legal Question in Family Law in Pennsylvania

no fault divorce

Dear LawGuru,

Where can I find a detailed description of the no fault divorce process, in Pennsylvania? I am wondering how to file a no fault divorce, and if it's possible to avoid court appearances.

Also, when a minor child is present, must the divorce address custody issues, or can custody be handled separately?

Is there a way to determine custody without the courts? For example, can the divorcing parties come up with there own signed agreement? In this case, would any court appearances be necessary?

Thank You.

Each County Court has a law library. The procedures are located in the Pennsylvania rules of Civil Procedure. Custody should be determined but it is not nesecceray. The parties usually can avoid a full court appearance, but might be required to attend an office conference to have there signed agreement approved. Divorce operates to limit and give important rights and should be done with the advice of counsel. I offer free consultations.
