Legal Question in Family Law in Pennsylvania

I live 3 miles from my x. Have 2 sons. They live with dad every other week then me. Recently my younger, 14, has been found failing 3 classes. When addressed about it he became mouthy and ran away to his dads. Before leaving we fought and I squeezed his cheeks so when he got to his dads, fabricated a lie and they had him call the police on me. Police investigated and told them (and me) I did nothing wrong. Meanwhile, this is my week and they will not send him home. Allowing him to do all the things he normally would. No punishment. They are teaching him to disrespect me. Do I have any rights to make him come home?

If this is your week to have the children, then you have every right to demand that the father send your son to you. If he does not, you should and must file a Petition for Contempt against your ex.

In fact, if you believe that your ex is "brainwashing" the children in such a way that he is turning them against you and you have solid proof (Not just a "feeling" or a "hunch") that your ex is attempting to turn the child or children against you, then you should consult with an Attorney and file an action based on "Alienation of Affections". Courts have been very harsh with the parent who is trying to turn the children against the other parent. When I say "harsh", I mean that when a Court finds that the other parent has been trying to turn the child or children against the other parent, the Judge has taken away all custody rights of the parent who was planting these ideas in the child or children.
