Legal Question in Family Law in Pennsylvania

I want to know if Primary physical child custody is likely to be rewarded to me (father) or the mother of the children; considering the following: I had Primary custody until I was Incarcerated (Felony) my attorney and I also fabricated a reason to explain my actions (mental disorder). However I have m6y degree in Clinical Psychology and am sure I will pass any Mental Health Assessment. The mother of the children is neglecting the children's health and I have 2 police reports that state that law enforcement had to be called to take my children to the hospital. Also the woman watching my children while their mother works is physically abusive and D.H.S took her child. My children witness domestic abuse, and complain of the living conditions. Who is likely to receive primary custody?

John Davidson Law Office of John A. Davidson

Depends on several things. First what sort of felony did you commit. Next there are 16 factors to determine primary custody. Add to that you and your lawyer fabricated an excuse for your felony. If I'm the judge I'd be leaning to door Number 3.
