Legal Question in Family Law in Pennsylvania

I am currently getting ready to file for divorce. My husband and I have been separated for 5 years. He is currently serving a 4 - 10 year sentence in a state prison for burglary and the sale of narcotics to an undercover police officer. Do I still have to wait the 90 day waiting period for my divorce to be finalized under these circumstances?

No, you could file on 2 years Separation. You could also file based on his incarceration.

The 2 years separation grounds would be the quickest.
