Legal Question in Family Law in Pennsylvania

Relocation Custody

My husband and I divorced this summer, We lived in Montgomery county PA. I had no family there and no way to live there and be able to support my daughter so I knew I needed to move back to Missouri. The lawyer I talked to told me I had a 90% chance of winning custody cause the judges in PA don't grant relocation custody. I am very upset and want some advice for now I have been away from my daughter for 6 months and I want to fight for custody but not if it's such a deffinate loss.

Re: Relocation Custody

I am a Montgomery County family law attorney. There is no generalization as to whether PA or Montgomery County judges permit relocation. There is specific case law which guides judges.I would suggest that if you have already been away from your daughter for 6 months, you do not wait any longer, as that will impact a judge's custody decision.

Each case is handled on a case by case basis, so I would need to have more information. Please contact me if you would like to discuss this matter.
