Still Waiting To Divorce

My Husband filed for a divorce in January of 1997 after I left him because of activities he was involved in on the internet. I am more than willing to sign the divorce papers, but have been told that since my Husband is not of stable mind (he claims to have mental problems),the divorce can not be finalized until he is able to sign as well. Why am I not able to sign the papers and be divorced ?? There are also 2 children involved and visitation was set up at one time but the children are refusing to see him. Their ages are 13 and 15 and I was told that they are old enough to make their own decisions. They dis-respect him due to the fact that he had internet affairs and do not wish to see him. I receive no support for the children other than Social Security Benefits that they receive through my Husband since he claims he is mentally ill and can not work.

You have a somewhat complicated situation and clearly need to speak with an attorney. It sounds as if a guardian needs to be appointed for your husband to authorize the guardian to act on his behalf for the divorce action. If your children receive social security as a result of your husband's disability that can be used to offset his support obligation. Again, you need the advice of an attorney.
