Motion to change Venue

Appeal of Small Claim Judgement

Plaintiff lives in NY/ defendant resides in PA breech of contract occured in NJ.

can the plaintiff ask to have a change of venue to NJ?

The plaintiff files the action. he/she gets to choose the venue when he/she files.

The plaintiff may petition for a 'change of venue', but that would be unusual. it is the plaintiff who makes the original choice of venue.

The new court would apply the same laws as the original court would have. 'Choice of Law' is not affected by venue.
