Green Card and Criminal Conviction

Can a person with a conviction for fraud in their home country, 20 years ago, who served about 5 years, still apply for marriage based green card in the US after being here legally on another visa (E-2) for last 10 years and never getting in trouble. That conviction was possibly expunged but this person admitted to INS that he/she had this conviction when getting the other visa. Please help. Thank you.
