hi i'm here in US on H4 visa with my husband , i have 2 US born children under age 3 .. my husband is looking for divorce my question is that can i get US citizenship based on my children US citizen status . the children will be living with me and i want to provide them with the best i can ..thank u so much

As a dependent H-4 you will lose this status once you divorce the principal beneficiary H-1B spouse. Your U.S. children can only petition for you once they are 21 years or older. You need to change your status from H-4 to possibly H-1B (if you qualify) or some other visa. Contact my office for a free consultation.
