Legal Question in Immigration Law in Pennsylvania

Hello,

I am on my H1 B visa. I got my Visa stamped in Canada on 02/11/2013.

I have an employer but was working for a client. My contract with my client ended on 02/25/2013. However, I still work full-time for my employer.

I would like to take an unpaid vacation for 4 months. I want to travel to India. is it safe to take a 4 months unpaid vacation when am on my H1B?

Will I need a client offer letter when I enter the USA after 4 months?

Please advice.

Hi,

Your employer is not required to pay your salary is you are outside the U.S. and not performing any services for the employer while abroad.

You can enter the U.S. on current unexpired H1B visa stamp if the purpose of your entry is employment with the H1B employer that is consistent with the information provided on the H1B petition including the location of the job as specified on the Labor Condition Application (LCA).
