Legal Question in Insurance Law in Pennsylvania

Insurance Co. Liability

We had Limited Coverage & Limited Tort Insurance and foun out that that wouldn't take care of nothing if something happened. We had it for a number of years. Then, once learned, we up graded it, getting Full Coverage and Full Tort asking for all benefits. The Rep said ok I've put it in for you and you should start sending in the amount of money required. We did that ofr a number of years, only to find out when someone hit us, they're trying to say we only had limited coverage and limited tort. The only proof I have that I asked for it, I put it on our check that there was a policy change. They did not send me anything new to sign and I ask, they just said send more money and I did. It was to cover me for a 50,000 house and loss wages if I couldn't work. But they said I don't have any of that. I'm so upset, because I lost my job and now my house. What are they responsable for if I send them what they told me to and then tell me I don't have anything. This took place in Philadelphia Pa.

Re: Insurance Co. Liability

You absolutely need to speak to an attorney about a potential case against the insurance agency as well as the carrier. If you paid the equiv. of full tort premiums, you should be entitled to full tort coverage regardless of how the carrier has you listed. If you have an attorney for the underlying accident, he/she should be working on this for you. Feel free to contact me if you desire additional information.
