Legal Question in Insurance Law in Pennsylvania

Parked car accident

My Daughter was driving (only with permit) and she pulled in a parking lot in a local eye docotor office. When parking she side-swipped a parked car. Police officer was called and a non-reportable accident was filed. Other person called my insurnace company to file claim. My insurance was expired (not known by me, forgot to renew)so he called my house to see what I will do about damages. Am I responsable for paying his damages since accident was on private property and a non-reportable accident? Only damage done was paint scrapping on his car. No dents or brakage. More damage to our car then his. I know I don't have insurance right now but in processe of getting new insurance.

The accident is non-reportable because it did not happen on a roadway. You will have to pay for the damages. Have the other driver provide two estimates and offer the lower amount. Get a general release signed so that they can't sue later.

Your daughter is clearly legally responsible, and it is likely you are too since you were acting in a supervisory capacity. It is not relevant that it happened on private property. Since you were uninsured, the best thing you can do is negotiate the best settlement with the owner of the other car. make sure you obtain a written release from the owner at the time money is paid. Of Course you are responsible, actually you and your daughter are both responsible for this accident. You should have several estimates take 2-3 and then offer the amount for the lowest one, also make sure the owner of the damaged vehicle signs a release and / or settlement agreement or you might still be sued at a later date.
