Legal Question in Employment Law in Pennsylvania

Obligation to Inform - Conviction

We recently hired a new employee who was very forthcoming about a criminal conviction (voluntary manslaughter) prior to serving the US Armed Forces in 2001 for 4 years. We do not have a policy that prohibits from hiring the candidate, but I'm wondering if we are legally obligated to inform our employees about this. Thanks!

Re: Obligation to Inform - Conviction

I commmend you on giving someone with that background an employment opportunity. There are very specific rules regarding the use and disemination of criminal history information. A link to the complete statute is here : http://members.aol.com/DKM1/18.Cp.91.html

You should speak with an attorney to advise you on what should be disclosed what must be disclosed and what must not be disclosed. I offer free consultations.
