Legal Question in Employment Law in Pennsylvania

wife laid off, but then they hired someone new for her position

My wife was recently laid off due to 'restructuring', but she discovered her position still existed and they hired a new employee. Is this even legal (in PA)?

Sorry your wife was discharged. These cases are fact-specific. If your wife is over age 40 and the replacement is in his 20s, I might want to take a look at asking some hard questions of the Empoloyer and its hiring department.

Google Title VII and the OWBPA and see if you learn anything pertinent to your Better Half. If an attorney takes your case, he will seek backpay and front pay on top of other economic damages. You should expect to pay a 40% contingent fee.

Good Luck.
