Section 8 housing paying of gas bill

Tenant agreed to pay for part of gas bill in cash no recept given to prove payment. Knowing that she should not but did it anyway for 5 yrs. Now bring up a law suit against landlord to reclaim money she paid willingly. The only thing landlord did was not read contract with HUD stating that the bills were included in with payment from them. Is this a criminal case? Will there be just a fine or jail time? Seeing as how the tenant was in the wrong aswell by willingly paying, knowing that she was not to, does that make her guilty as well and intitled to the cash back. She is also stating that that she was paying for the heat for the whole building (there are two seprate bills)a business is down below. She said she has no heat control in her apt. and she has a working thermostat. And that there is only one meter when there are two. She said she would write a check out to cash to pay for her part of the bill.

First off do not speak to anyone but an attorney because there may be a crime. Second, if you do not say anything the case is based on her word against yours and the prosecution has the burden of proof.
