Legal Question in Landlord & Tenant Law in Pennsylvania

Security Deposit

Can the Security Deposit be used for the last months rent? My landlords are telling me that it is illegal to use it for that. Can you let me know.

Re: Security Deposit

Not really statutorily illegal; i.e., the landlord-tenant act is silent on the issue. In reality, you should look at the language of your lease - it will tell you if it is permisible or not. The landlord may be able to sue you to recover the rent or if security deposit is applied to rent may be able to sue you for damage to the property that the security deposit would otherwise pay for. In general it is not a good idea to use it as your last months rent, but not illegal.
