Legal Question in Medical Malpractice in Pennsylvania

statute of limitations

I had a benign brain tumor removed 10/1992 and the doctor differed from the proceedure he described to me and my family. Consequently, the tumor has been growing back since then (1992). Is there a statute of limitations in medical malpractice cases? I'm to the point where I may need surgery again.

Re: statute of limitations

PA has a two year statute. Suit must be started within two years of the time you became aware of potential malpractice or should have become aware. The statute does not begin to run imeediately at the time of negligence. If it is within two years of the occasion when you were informed that there was a potential problem you have timely filed. Also if you were under 18 at the time of the service you have two years from your 18th birthday to bring suit.
