Legal Question in Personal Injury in Pennsylvania

On May 22, 08 I was driving to work when another car hit my car. My car a 1995 Geo Tracker will be totaled it was wrecked on the drivers front and has a bent frame. I have Full tort and a 10k health limit. I was offered $100 from the insurance company before I went to the hospital the next day. At the hospital I had 4 X-Rays of my neck and 3 taken for my left knee. I am sore can not turn my neck to the right and I go to work because I have to pay bills. I work in construction and have to be at work to get paid. I have a doctors appointment on friday May 30th and will speak to him about this matter. I do not want to milk the insurance company but I dont want something to develop from this in the future. The hospital paper says I have a sprain neck and left knee. I put a brace on my leg at night. The hospital said that the X-Rays shows that I have arthritis as a person of 51 would have. If I get an attorney on this and the insurance company offers me a settlement will we each share in the settlement? What should I do? I dont want to lose this job. If I leave I will be replaced, they have a time limit and have to finish the job.

That is pretty low of the insurance company to go after you like that. I would recommend following your doctor's medical advice on treatment. Since this is a recent accident, and as I know from my 3 accidents way in the past, things come up some time after the accident. It does not require that your take time off from work, unless medically necessary. If so, then a wage loss claim can be submitted. The doctor may recommend physical therapy, which can be worked out with your work schedule. I only take a contingency fee-you pay nothing up front out of pocket. Don't even think about talking to the insurance company about getting paid for your injuries until you have been pain-free for at least 1 month. Work as much as you are able to work. Go to doctors as needed and as your family doctor recommends. Hire a local attorney on a contingent fee basis to help you through this situation. I agree with the advice given to you. You should always follow what your medical doctor says. If you have pain and discomfort you should certainly treat with the proper medical persons. If you are able to work then do so. If you have to miss time from work then your insurance benefits may cover part of the loss. do not under any circumstances speak with the insurance company of the other driver until you have discussed this matter with a lawyer.
