compensation on a totalled vehicle

If a car accident was not my fault and the other driver was given a citation, and my car is a total loss, can I recieve the full amount that I owe to the bank instead of what the car is worth?

You are only entitled to the fair market value of the property not what you owe on the car. If the amount is close the threat of a lawsuit may make the insurance company pay the difference to avoid defending the lawsuit. I offer free consultations.
