Legal Question in Personal Injury in Pennsylvania

Slip and fall on Personal Real Property

I own a Townhome in Chester County, PA in which I pay a monthly association fee. The fee includes trash and snow removal, lawn maintenance, etc...

The association hires a contractor for snow removal that in the last two storms left a solid sheet on the walk way from my two assigned parking spots straight to my front door.

The association is responsible for any necessary repairs to the walkways leading to the houses, as I am still waiting for the association to re-pour mine. During the last storm, a delivery person fell while on the walkway leading to my house.

Am I, as the homeowner, legally responsible for any injury sustained from a fall on the walkway leading to my house or is the association legally responsible? How can I protect myself from any legal action should an injury occur as a result of shoddy snow removal?

1. You have to look at the Assoc documents to determine responsibility for a particular area. If the incident happened in the area which the Assoc was obligated to maintain, it is likely you will not be responsible for injuries which occurred on that area.

2. Assuming you have liability insurance, if you receive notice of a claim, notify your ins agent or ins co promptly. Even if you are not legally responsible, if a claim is made you need to be defended, & your insurer is obligated to provide a defense.
