Legal Question in Real Estate Law in Pennsylvania

We have a cabin in the mountain that borders state game lands.we have a right of way to the driveway to enter it because some of it is state game lands.the deed states the right of way to ingress, egress and regress. Now many years later the state forestry sends us a letter saying we have to pay $125.00 to access this driveway now. Is this legal since we have always had a right of way.they want to charge $25 here after every year now to use part of the driveway that is theirs. Thank you, renee fleck

If the easement is recorded in your deed then probably not. It would be like the previous owner hitting you up for more money after you closed on the property.

Somebody paid for that easement when it was created, You shouldn't have to pay again.

Give me a call I want to know how they think they can do that.

In article 1 of the Pennsylvania Constitution Section 1 States:

 1. Inherent rights of mankind.

All men are born equally free and independent, and have

certain inherent and indefeasible rights, among which are those

of enjoying and defending life and liberty, of acquiring,

possessing and protecting property and reputation, and of

pursuing their own happiness.
