Legal Question in Real Estate Law in Pennsylvania

Condo assoc rules

My condo assoc just made up a new rule stating the color of curtains we are allowed to hang in our windows....white, ivory or beige. I understand they can make basically any rules they want about outside areas but how can they tell me what color curtains I'm allowed to hang inside my own home???!!!

Re: Condo assoc rules

You would need to read the Declaration of Condominium you received when you purchased. It will set forth what they can and can't do.

Re: Condo assoc rules

You asked if a Condo association can make rules regarding the decoration inside your unit.

The declaration often trumps so if you have an issue that is the place to start. There has been some judicial restraint on declarations but they are allowed great leeway. One thing they must do is allow anyone unit that currently has differently colored drapes to retain them. They can't require you to change something that was legal when you entered the contract.

My suggestion is to look at what they are trying to solev and try to come to terms with that. If they wish to only have nuetral colors showing then get a nuetral backing for the drapes. As a rule they cannot dictate regarding non-structural interior decoration.

Welcome to the most significant problem with homeowner association: living at the whim of the lowest common denominator. There is always the answer you can go and move to change the rules. Often these changes take place with very few owners voting.

Hope the answer helps.

Regards,
