Co-ownership Sale Of Property

My brother-in-law and I Co-own a piece of property. Due to severe differences we have agreed to sale the property. We obtained a fair offer and he has refused to sign the sales agreement even though the offer will expire shortly. I am ready to pursue ''Partitioning'' if necessary. How can I proceed? I & he live in Allegheny County, the property is in Potter County.

I suggest you obtain the advice of legal counsel. Since the property is located in Potter County, it logical for you to bring the action in that county. A partition action ultimately requires a sale of the property through a court appointed trustee. This is an expensive process and both you and your brother would receive less proceeds from such a sale. Obtain the services of an attorney to review how you hold title and see what your remedies would be.
